Terms for Organizers
As of 12. September 2026 · Version 2026-08-03+US-1.1
Translation. Only the German version is binding.
1. Scope
These terms apply to businesses and other promoters who submit prize draws and competitions to Mitspiel for publication, highlighting, reach support or technical implementation. Individual offers and service descriptions take precedence over these terms.
2. Responsibility of the promoter
The promoter is responsible for the lawfulness, funding and running of its prize draw or competition. In particular, it shall provide complete terms of participation, privacy notices, legal notice (Impressum) details, run times, a description of the prize and means of contact, and shall ensure that it holds the rights to texts, trade marks and images for the agreed use.
3. Review by Mitspiel
Mitspiel may review information for technical, editorial and security purposes, ask questions for the purpose of correction, and refuse or pause publication. The review does not replace legal advice and does not relieve the promoter of its responsibility.
4. Labelling and placement
Paid services are labelled as advertising, advertisement, sponsored or highlighted. A particular position, reach, number of entries or commercial success is owed only if expressly agreed in the offer.
5. Participant data
Where participant data is collected via a campaign page provided by Mitspiel, the roles, purposes, legal bases, consents, retention, channels for access requests and data export must be determined before publication. Marketing consents must be kept separate from mere participation in the prize draw or competition and must be designed so that they can be evidenced.
6. Remuneration
Prices, scope of services, term and due dates are set out in the offer or checkout. Unless stated otherwise, B2B prices are exclusive of statutory value added tax. Additional services are charged only by agreement.
7. Term and cancellation
One-off services end upon expiry of the agreed campaign. Changes or cancellations after the start of production or publication may be charged proportionately. Mitspiel may suspend services in the event of legal violations, security risks, lack of cooperation or default in payment.
8. Liability and indemnification
The promoter shall indemnify Mitspiel against justified third-party claims arising from content it has provided, missing rights or unlawful implementation, insofar as it is responsible for the cause. In all other respects, the statutory liability rules and any agreed limitations of liability apply.
9. Contact
Please direct questions about promoter services and these terms to service@mitspiel.com.
