Mitspiel Club Terms of Service

1. Scope

These Terms of Use apply to the free use of Mitspiel and to the paid Mitspiel Club, in particular the prize draw directory, user account, favourites, personal lists, notifications, assisted and automatic participation functions, and the Club waiting list. The provider is Schlachter Advertising GmbH, Westermühlstraße 21, 80469 Munich, Germany.

2. Third-party prize draws

Mitspiel does not organise the prize draws listed in the directory, unless a promotion is expressly designated as a Mitspiel promotion. The contractual partner for participation, administration, the draw, notification and prize delivery is the organiser named in each case. The organiser's terms of participation and privacy notices apply.

3. No guarantee of winning

Mitspiel does not influence draws and does not promise any prize. Information on prizes, duration, type of participation and organiser is prepared with reasonable care, but may change on the organiser's side. The official promotion page is always authoritative.

4. User account

An account requires a valid email address and a secure password. The information provided must be truthful, up to date and attributable to your own person. Access credentials must not be shared. If you suspect misuse, Mitspiel must be informed without undue delay.

5. Personal data and participation settings

You decide which profile and preference data you store. Mandatory information depends on the function being used. Consents for newsletters, the waiting list, marketing or external analysis are voluntary and can be withdrawn separately.

6. Permitted use

In particular, the following are prohibited: automated mass access outside the interfaces provided, circumvention of protective measures, manipulation of clicks or statistics, unlawful content, use of other people's identities, and attacks on the availability or security of the platform.

7. Availability and changes

Mitspiel endeavours to provide stable operation but, for free services, does not owe uninterrupted availability. Functions may be changed, restricted or discontinued for reasons of security, quality, law or maintenance. Material changes will be appropriately indicated.

8. Suspension and termination

You can delete your account at any time in the account area. Mitspiel may temporarily suspend or terminate accounts in the event of significant or repeated violations, security risks, misuse or statutory obligations. Where possible, an opportunity to clarify the matter will be given beforehand.

9. Liability

Mitspiel is liable without limitation in cases of intent and gross negligence, for injury to life, body or health, and under mandatory statutory provisions. In cases of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable, typical damage. The respective organiser is liable for the administration and fulfilment of third-party prize draws.

10. Paid Mitspiel Club

After a free trial period of 30 days, the Mitspiel Club costs $9.90 per month and can be cancelled at any time with effect from the end of the current billing period. A contract is only concluded by express completion in the Stripe checkout. Registration alone does not trigger any obligation to pay.

Mitspiel finds suitable prize draws, prepares entries and submits them automatically where this is technically and legally possible. For some prize draws, a brief confirmation or another personal step is required. No fixed number of automatic entries and no prize is owed.

Automatic entries are made only for active, current and technically clearly certified forms. CAPTCHA, double opt-in, new or changed advertising consents, quiz fields that cannot be automated and comparable personal steps are displayed in the dashboard. Telephone, SMS, postcard, purchase requirements and technically unsuitable promotions are not part of the automatic service.

During onboarding you grant a versioned power of attorney for participation. Voluntary newsletter or advertising consents are technically set only upon a documented approval that exactly matches the organiser, purpose, channel, text and URL. You can pause the Club automation, cancel the subscription and withdraw consents with effect for the future.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which a consumer has their habitual residence remain unaffected. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
